Absentee
Bid Information
All absentee bids for the Saturday,
May 18, 2013 auction must be received by no later than 6 pm EST on
Friday, May 17, 2013.

No absentee bids
will be accepted in amounts less than $50.00 without prior consent of
the
auction firm.
When two or more
absentee bids exist for any one item, the minimum the item will sell
for must be no less than the amount of the lowest absentee bid plus one
additional bid increment.
It will be the
responsibility of the absentee bidder to obtain a condition report for
any and all lots on
which the absentee bidder intends to place an absentee bid. By placing
an absentee bid, a person or organization placing the absentee bids(s)
agrees that he/she or organization is satisfied that the condition of
the item, on which the bid is placed, is satisfactory and meets the
minimum requirements of the bidder. Further, the absentee bidder agrees
that any absentee bid placed on any item signifies that the bidder
holds the auction firm free of any subsequent claim regarding the
condition of the auction item. Additionally, the absentee bidder
acknowledges that he/she or the organization leaving the bid(s) has the
right to examine the item in person prior to the auction or may have a
representative examine the item on their behalf prior to the auction.
Bids received from
the auction floor in live bidding on the day of the auction will take
precedence over identical absentee bids.
Absentee bids must include a 10% buyers
premium.
All absentee bids must include a phone number or
other method for immediate contact.
By placing an absentee bid, a person or
organization placing the absentee bid(s) agrees to abide by the "Terms
of Sale" and absentee bidding procedures outlined herein.
Terms & Conditions of
Sales
Identification: All purchasers are required to
register for a bidder number and to provide full name, address &
proper verification.
Additions to or
withdrawal from sale: The auctioneer reserves the right to withdraw
from sale any of the items listed, or to sell at this auction items not
listed. The auctioneer further reserves the right to group one or more
lots into one or more selling lots, or to divide any one lot into two
or more selling lots. Whenever the best interest of the seller will be
served, the auctioneer reserves the right to sell all of the items
listed in bulk.
Dispute between
bidders: If any dispute arises between two or more bidders, the
auctioneer will settle said dispute or may immediately put the disputed
lot up for resale to the highest bidder. The decision of the auctioneer
shall be final and absolute.
Reserve: The auctioneer reserves the
right to reject any and all bids. On lots upon which there is a
reserve, the auctioneer shall have the right to bid on behalf of the
seller.
Condition of
items sold: The auctioneer shall not be responsible for the correct
description, authenticity, genuineness of, or defect in any lot, and
makes no warranty in the connection therewith.
No allowance will
be made or sale set aside on account of any incorrectness, error in
cataloging, or any imperfection not noted. No deduction will be allowed
on damaged articles as all goods being exposed for public exhibition
are sold "as is" and without recourse.
Time of payment: All bills must be paid
in full before the end of the auction day and prior to shipment to
absentee buyer.
Manner of
payment: All bills must be paid to representatives of the
auctioneer at the auction unless otherwise announced. The full purchase
price on all lots sold to the same buyer must be paid within the time
fixed and before removal of any of the items.
Compliance with
terms of sale: In default of payment of bills in full within the
time herein specified, the auctioneer, in addition to other remedies
allowed by law, may retain all moneys received, as deposit or
otherwise, as liquidated damages. Lots not paid for and removed within
the time specified herein may be resold at public or private sale
without further notice, and deficiency, together with all expenses and
charges of re-sale, will be charged to the defaulting purchaser.
Additional terms and conditions: Any
additional terms or conditions of sale, added by auctioneer, shall be
announced prior to auction.
Removal:
Removal shall be at the expense, liability, and risk of the purchaser.
Purchases will be delivered only on presentation of paid bill.
Auctioneer shall not be responsible for goods not removed with-in the
time specified, and shall have the option of removing and storing at
the expense and risk of the purchaser any article purchased, but not
paid for and removed within the specified time.
Non-delivery
responsibility: Auctioneer shall not, in any event, be liable for
non-delivery or for any other matter or thing, to any purchaser of any
lot, other than for the return to the purchaser of the deposit or sum
paid on said lot, should the purchaser be entitled to it.
Claims: No claims will be allowed after
goods are removed from premises.
Personal and
property risk: persons attending during exhibition, sale or removal
of goods assume all risks of damage of or loss to person and property
and specifically release the auctioneer from liability therefore.
Neither the auctioneer nor his principal shall be liable by reason of
any defect in or condition of the premises on which the sale is held.
Records: The record of sale kept by the
auctioneer and bookkeeper will be taken as final in the event of any
dispute.
Agency: The auctioneer is acting as agent
only and is not responsible for acts of its principals.
Long Gun Policy: Based on Michigan law,
it is our policy that:
1. No firearm will be sold to individuals who are not 18 years of
age and a resident of Michigan, Indiana, Ohio (except Columbus) or
Wisconsin.
2. No firearm will be sold to anyone not in attendance or
personally picking up the gun following successfully bidding at the
auction.
3. No firearm will be sold to anyone who cannot or will not
certify that he/she is not subject to restrictions based on criminal
history, mental health history, or other disqualifying factors.
4. No firearms will be sent or transported over state lines by
any Americana Auctions personnel or representatives.
Shipping Information
Unless otherwise agreed to, all shipping,
handling and insurance charges will be the sole responsibility of the
successful high bidder.
The successful absentee bidder must make full
payment for the item prior to shipment of the item to the buyer.
